SMS Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the SMS text messaging service provided by Clever Ducks. By opting in to receive text messages from a Clever Ducks employee, or by exchanging text messages with one of our employees, you agree to these Terms together with our SMS Privacy Policy, both of which are incorporated by reference into our general Terms of Service and Privacy Policy.
“Clever Ducks,” “we,” “our,” and “us” refer to Clever Ducks, 1313 Broad Street, San Luis Obispo, CA 93401.
What This Service Is
Clever Ducks employees use SMS text messaging through Microsoft Teams to have one-to-one conversations with you about your IT services. Each employee uses their own assigned work phone number. The conversations are person-to-person — there’s a real Clever Ducks team member on the other end, not a marketing system or an automated platform.
Types of messages you can expect:
- Service and support coordination (scheduling, arrival times, follow-ups)
- Updates on open tickets, projects, or work in progress
- Questions or clarifications related to your IT environment
- Operational notifications relevant to a specific conversation you’re already having with us
- Automated replies to the keywords described below (opt-in confirmation, help, opt-out confirmation)
We do not use this service for marketing, promotional, bulk, or transactional messaging.
How You Opt In
You opt in to receive SMS messages from a Clever Ducks employee when you provide your mobile phone number to us in connection with our services and confirm that you’d like to be contacted by text, or when you reply START to a message from a Clever Ducks number. Your opt-in is specific to the conversation between you and that employee’s number.
Message Frequency and Costs
Message frequency varies. Because this is conversational person-to-person texting, the number of messages depends entirely on the conversation you’re having. You’ll receive an initial confirmation message after opting in, and after that the cadence is determined by the back-and-forth between you and the Clever Ducks employee.
Message and data rates may apply. Clever Ducks doesn’t charge you to send or receive messages through this service, but your wireless carrier may charge you for messages based on your mobile plan. Contact your carrier if you have questions about charges.
How to Opt Out, Get Help, or Resume
You can manage your participation in this service at any time using these keywords. Send them to the Clever Ducks number you’re texting with — opt-outs apply to that specific conversation and number.

| STOP | You’ll receive a confirmation that you’ve opted out of that conversation, and no further messages will be sent from that number. Synonyms also recognized: QUIT, END, REVOKE, OPT OUT, CANCEL, UNSUBSCRIBE. |
| HELP | You’ll receive support contact information so you can reach Clever Ducks for assistance. |
| START | You’ll receive a confirmation that messaging has resumed. |
Because our SMS service is one-to-one between you and a specific employee’s number, an opt-out request applies to that conversation. If you’d like to stop messages from a different Clever Ducks employee or number, send STOP to that number as well, or contact our Service Desk and we’ll handle it.
Privacy
Information you share with us through SMS is governed by our SMS Privacy Policy. In summary: we use mobile information to communicate with you about your services. Mobile opt-in information will not be shared with third parties for marketing purposes. Opt-in data and consent will not be shared with any third parties. We share message information only with the platform and carrier providers who help us deliver the service, and as required by law.
Eligibility
To use this SMS service, you must be at least 18 years old, and you must be the owner or authorized user of the mobile phone number you provide. By participating, you confirm both.
Service Availability and Changes
SMS is provided through Microsoft Teams and the United States and Canadian mobile networks. Service availability, delivery, and timing depend on factors outside our control, including carrier performance, device condition, and network coverage. We can’t guarantee delivery of any individual message. We may modify or discontinue this SMS service, or any feature of it, at our discretion.
We may update these Terms from time to time. The “Effective” date at the top of this page reflects the most recent version. Continued use of the service after we update the Terms means you accept the changes.
E-Sign Disclosure
By agreeing to receive text messages from us, you also consent to the use of an electronic record to document your agreement. You may withdraw your consent to the use of the electronic record by replying STOP.
