This SMS Privacy Policy explains how Clever Ducks handles the mobile phone information you share with us when you exchange text messages with our employees. It applies only to text (SMS/MMS) communications sent or received through Clever Ducks employee phone numbers in Microsoft Teams. For everything else, our general Privacy Policy applies and is incorporated here by reference.

In this document, “Clever Ducks,” “we,” “our,” and “us” refer to Clever Ducks, located at 1313 Broad Street, San Luis Obispo, CA 93401. “You” refers to anyone who exchanges text messages with one of our employees.

What Information We Collect

When you exchange text messages with a Clever Ducks employee, we collect:

• Your mobile phone number
• The content of the messages you send to and receive from us
• Delivery and timestamp information associated with those messages
• Records of your opt-in and any opt-out requests (for example, replying STOP)

How We Use This Information

We use the information you provide through SMS for one purpose: to communicate with you about your service relationship with Clever Ducks. That includes coordinating support visits and appointments, responding to your questions, confirming work performed, sharing operational updates relevant to your IT environment, and following up on tickets and projects. Our SMS service is for conversational, person-to-person communication between you and a specific Clever Ducks employee assigned to your account.

We do not use SMS to send marketing, promotional, transactional, bulk, or automated messages.

How We Share This Information

Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. Opt-in data and consent will not be shared with any third parties.

We share message and phone number information only with the service providers who help us deliver text messages on our behalf — for example, Microsoft (which provides the Teams calling and SMS platform), the wireless carriers that route messages between our network and yours, and similar communications vendors. These providers are permitted to use the information only to deliver our messages and operate the service.

We may also disclose information when required to comply with a law, regulation, subpoena, court order, or other valid governmental request, or when we believe in good faith that disclosure is necessary to protect our rights, our team, our clients, or the public.

How Long We Keep It

We retain message content and related metadata for as long as it remains useful to support your service relationship with us, and as required by our records retention obligations. Opt-out records are retained as needed to honor your preferences going forward.

Your Choices

You can stop receiving text messages from a Clever Ducks employee at any time by replying STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE to that employee’s number. Because our SMS is one-to-one between you and a specific employee, your opt-out applies to that conversation and that number. You can resume by replying START. You can also request help at any time by replying HELP.

Children’s Privacy

Our SMS service is intended for adult business contacts. We do not knowingly collect mobile phone information from children under 13.

Changes to This Policy

We may update this SMS Privacy Policy from time to time. When we do, we’ll update the “Effective” date at the top of this page. Material changes will be communicated in a manner appropriate to the change.
